Overall Note:

The terms and conditions on this page are the intellectual property of Carol Brailey developed over years and years of client experience and are copyrighted and are legally protected via INTEROCO (link). If wanting to license these terms and conditions for re-use and re-branding for your practice, you can secure a license to re-use our terms and conditions in the Products > Digital Downloads for Virtual Colour Analysis Professionals on our site. We do not permit referring to (to assist with building your site), paraphrasing, use of copying and paste of these terms and conditions and re-branding for your own purposes without consent or a license and will pursue one or all of the following if uncovered they have been re-purposed without our consent for your image consulting and/or colour analysis practice: legal repercussions, Association of Image Consultants International (AICI) ethics review (which could lead to loss of membership and certification if found to be in violation of code of ethics), removal from other professional groups, filing a copyright complaint with your website host.

Personalized Virtual Colour Analysis Package Terms and Conditions:

1. Our colour analysis services are only for people age 17 and over.

2. For clients who are below age 18 (i.e. age 17), a parent or guardian must submit the payment and colour analysis pictures and information on the minor’s behalf.

3. There are no refunds other than if during the picture and information submission review, it is revealed the client is less than age 17 and/or the parent or guardian has not participated in the booking process, we will immediately cancel and refund the booking. If the booking was made by a parent or guardian, the refund amount will be the amount paid less PayPal transaction fees charged to us for the transaction. If the booking was made by the person under the age of 18, the refund amount will be the full amount paid.

4. The accuracy of virtual colour analysis is dependent on the quality of lighting and photo quality which you as the client are in control of and therefore we do not guarantee accuracy of results. We advise you to review all pictures sent in terms of quality and accuracy to your true in person colouring before sending.

5. All photos received are kept confidential and deleted from our email system and any associated folders within one week of your virtual colour analysis. Note: your personalized report, which may include your photo(s) is saved in our files.

6. It is quite common for most to all of our clients to be surprised by their results. If you experience this, we recommend viewing some of our free TikTok or YouTube videos to assist with your questions.

7. In regards to the personalized report (including colour backgrounds used) and digital colour references you will be sent: Contents of your report and the digital colour references are copyrighted and permission is only being granted for your personal use only (which includes not granting permission to post to social media); we do not give you permission to share beyond your personal use or social media etc. Please keep in mind that all printers are different, and the colours may not print true. We do not provide replacements of downloads once they have been downloaded. It is advised to store the download in a safe and backed up spot in the event the hardware where you view the download encounters an issue.

8. This package does not include post-analysis email or question support if you have not secured a post-virtual colour analysis consultation option for an additional fee. Due to time and volume capacity constraints, Carol is unable to read and respond to client emails. If you have chosen the Personalized Virtual Colour Analysis Package and email us questions after receiving your results, a member of our support team will respond copying and pasting this term and condition in an email along with a link to our full terms and conditions you agreed to when signing up for this service. When receiving results and there are questions, please see your digital colour analysis download for answers to your questions, we find the resources in there answer typically 95-100% of questions asked. When you sign up for our services, you are asking Carol’s professional opinion on your colour analysis result based on the picture and information submission you provided using the International Image Institute system and her training and experience in this system. This is the service we provide. The result given by our service may or may not agree with your self colour analysis and/or the colour analysis checks of another professional. She takes great care in reviewing all submissions and is a person of integrity. Any emails sent after receiving results expressing disagreement, denial, shock etc. requesting further explanations, support etc. are responded to as per above as your package does not include post-colour analysis email support and we are not equipped to support these sorts of emails. Please do not sign up for this package if the inclusions, exclusions, terms and conditions are not a fit for you. 

9. Carol Brailey (2319114 Ontario Ltd.) disclaims any liability for your reliance on any opinions or advice from your online colour analysis.

10. If you choose to pay for this package and do not send us the pictures and information for your package on the same day as your payment, we may not be able to accommodate you on the date when you send us your pictures and information as we have limited availability to perform colour analysis each day. Please email us at info@carolbrailey.com upon paying for this service to let us know when you plan to send in your pictures and information if not on the same date as your payment. If you choose to pay for this package and we do not receive your pictures and information by 4pm ET the day following your payment, we will automatically cancel your booking and provide you with a refund (refund amount will be amount you paid less transaction fees charged to us for your transaction). We limit the number of clients we receive per day and need to align submissions with our capacity per day and unfortunately, we need to receive your submission usually on the same date as your payment or around the same date as your payment to ensure we have capacity to complete your analysis (as there is a limit to the number of clients we can have in waiting for a colour analysis).

11. No package upgrades are accepted after your payment is completed.

12. If you are booking this service after May 13, 2024 your colour analysis result may or may not have been arrived at by a second colour analysis professional (i.e. Karen Brunger).

13. We do not provide replacement download files for the digital colour references and/or your results email and/or report once they have been downloaded. It is advised to store your results email, report and download(s) for your package in a safe and backed up spot in the event the hardware / software where you view the download and/or email encounters an issue (this term is mainly to address scenarios where clients may contact us after more than a month after their results were sent having lost their original downloads which we likely will no longer have on file).

Basic Virtual Colour Analysis Package Terms and Conditions:

1. Our colour analysis services are only for people age 17 and over.

2. For clients who are below age 18 (i.e. age 17), a parent or guardian must submit the payment and colour analysis pictures and information on the minor’s behalf.

Please also note: the Basic Virtual Colour Analysis Package is a no-support package; if your initial submission is not optimal, we will send you one courtesy email indicating items in your initial submission that we recommend re-submitting only. If your re-submission is not optimal, we will do our best with what you send.

In-Person Colour Analysis Package Terms and Conditions:

1. Our colour analysis services are only for people age 17 and over.

2. For clients who are below age 18 (i.e. age 17), a parent or guardian must submit the payment and colour analysis pictures and information on the minor’s behalf; if the client is age 17, a parent or guardian will also be required to attend the in-person appointment.

3. Due to our limited availability for this appointment type, we are not able to accommodate re-schedule requests. Appointment cancellation requests made more than 25 business days before your appointment and automatic cancellation of appointments due to non-receipt of pictures and information by 4pm ET the date following your payment/booking, will be charged a $100 CAD (plus HST if applicable) administration fee to cover our financial-time loss , transaction fees and space rental fee considerations.  No-show appointments and/or cancellation requests made less than 25 business days before your appointment cannot be accommodated for refunds due to the spot taken not being easily offered to someone else and the costs/time we have incurred for your appointment.

5. Carol Brailey (2319114 Ontario Ltd.) and Elysse Acosta disclaims any liability for your reliance on any opinions or advice from your colour analysis.

6. If you choose to pay for this package and choose not to send us the required pictures and information by 4pm ET the date following your payment/booking, we will automatically cancel your booking and provide you with a refund – refund amount will be amount you paid less $100 CAD admin fee (plus HST if applicable) to cover our financial-time costs including transaction fee costs of your cancellation of our service. We need to have your pictures and information before your appointment to prepare for your appointment (which includes Carol Brailey pre-reviewing your pictures). Our business days are Monday to Friday, excluding Canadian Stat Holidays.

7. If you are not a resident of Ontario, Canada, 13% HST will be charged to you separately after your checkout through PayPal (note: if a resident of Canada and not Ontario, Canada the difference of 13% HST will be calculated for you). Due to this service being performed in-person in Ontario, Canada we must charge HST to all clients of this service. Failure to pay the separate payment of HST before 4pm ET the date following your initial payment payment for this booking will result in the appointment being automatically cancelled and we will issue you a refund (refund amount will be the same refund amount as indicated for the scenario in #6 above).

8. This service does not include post-colour analysis question support (includes email support, phone support, text support etc.). Please arrive to your appointment with all of your questions gathered and ask those during your appointment.

30 Minute Post-Virtual Colour Analysis Consultation Terms and Conditions:

1. If you pay for a post-virtual colour analysis consultation and we do not receive your accompanying calendar entry within 3 calendar days, we will refund you and cancel your booking (refund amount will be amount you paid less transaction fees charged to us for your transaction).

2. Due to our limited availability for this appointment type, we are not able to accommodate re-schedule requests.

3. Appointment cancellation requests made more than 25 business days before your appointment can be cancelled with a refund (as your spot will be able to be offered to someone else). Refund amount will be amount you paid less transaction fees charged to us for your payment/refund.

4. Appointment cancellation requests made less than 25 business days before your appointment, including no show appointments cannot be accommodated for refunds (due to us not being able to offer spot to someone else).

Gift certificate terms and conditions:

Gift Certificate Terms and Conditions:

1. There are no refunds.

2. Gift certificates expire 60 days from the purchase date (no exceptions as our site currently does not allow processing beyond 60 days and unfortunately, we cannot guarantee spaces for the gift receiver beyond 60 days). This means all of the package benefits must be used by the purchaser and/or gift recipient within 60 days of the gift certificate purchase date. 

3. The cost of one or all of our packages may increase within the 60 days after the the gift certificate is purchased and within the 60 days that the gift code is active. If this occurs, the gift recipient will be prompted upon checkout to pay the difference. It is advised that the gift recipient use the gift code promptly to mitigate this situation occurring.

4. All gift codes must be redeemed by entering the gift code in the promo code field when checking out for a package as this is how the client/gift receiver agrees to the terms and conditions for their package. Please be aware that it may be possible when the gift receiver attempts to checkout for their package that they will not be able to do so in the event we have hit our maximum number of clients on the date that they enroll. Which means they may have to wait 1-2 business days to enroll in their package.

5. For Canada-based purchasers, please be aware as per CRA guidelines HST cannot be charged when issuing a gift certificate, however it will be charged to the gift recipient when the gift recipient uses the gift certificate.

Digital download terms and conditions:

Digital Download Terms and Conditions:

1. There are no refunds.

2. The download link will expire after 120 hours or after 3 attempts, whichever happens first.

3. All of our digital downloads are copyrighted.  Permission is only being granted for personal use only when downloaded (this includes not granting permission to post on social media). No part of our digital downloads may be reproduced in any form or by any means, or be resold without the express written consent of the author. Digital download license exception: This product download only grants you a license to re-use, re-brand and customize, it does not give you a license to re-sell or re-share for others to use. The copyright and intellectual property of our downloads remains under our ownership.

4. We do not provide replacements of downloads once they have been downloaded. It is advised to store the download in a safe and backed up spot in the event the hardware where you view the download encounters an issue.

5. We do not provide technical support on how to download the download to your computer or phone. For downloads that are ZIP files, we do not provide technical support on how to unzip a file to your computer or device.

6. We do not respond to queries around details on the colour analysis palettes and/or how to use the palettes. The only clients where queries of this nature are responded to are from colour analysis clients who have purchased the 30 minute post-virtual colour analysis consultation appointment (questions will be answered during your Zoom call). 

7. The colours in the digital references for the palettes below are the same as described in the listing, there is only a VERY slight difference in the text of the download. If you choose to download the palettes with the same colours, no refund will be offered. These palettes where you may come across this scenario are: Warm Spring, Warm Autumn, Cool Summer, Cool Winter, Light Spring, Light Summer, Deep Winter, Deep Autumn, Bright Winter, Bright Spring, Muted Autumn, Muted Summer.

8. For the Virtual Colour Analysis Kit Add-On: If you need technical assistance following the steps to insert the add-on to your Template in Excel from the International Image Institute, in the instructions you are sent with the download there is an option to sign on for us to do this service for you for an additional fee. Otherwise, we do not provide technical support on this download.

9. If you are currently or have in the past been suspected of violating our copyright, unfortunately, a license to use our digital products will not be granted. We will review all purchasers of downloads and may contact you refunding your purchase (refund amount will be amount of your purchase less transaction fees charged to us) and revoking your license for use should this situation occur.
